Administrative Justice - Practice & Procedure for Decision Makers

The B.C. Council of Administrative Tribunals developed this course in order to provide new tribunal members with a better understanding of their role and responsibilities as tribunal members.

This two-day course provides information and exercises that will help tribunal members acquire the knowledge and skills they need to conduct fair hearings and write clear, well-reasoned decisions.

The course consists of four half-day sessions:

• Administrative Law and the Principles of Natural Justice
• Conducting Fair Hearings and Evaluating Evidence
• Decision Making and Decision Writing
• Independence, Accountability and Ethical Conduct.

Decision Writing Workshop

The objectives of this 2 day workshop are to enable participants to:

  1. bring a reader-oriented perspective to writing decisions
  2. organize and revise decisions to enhance logic and flow
  3. write clear, concise and coherent decisions
  4. gain confidence in decision writing within their tribunal context

The workshop introduces the elements of a good decision and tracks those elements from opening to conclusion with discussion and re-writing exercises.  Over the course of the two days, participants will re-write a “bad” decision and make it a “good” decision.   The workshop deals with various writing, grammar and punctuation issues that impact clarity and flow.  The workshop also discusses the importance of reasons and give participants some guidance on writing decisions that will stand up to judicial scrutiny for sufficiency of reasons. Participants will have homework for the evening between the two days. Participants may receive individual feedback on one of their own decisions.
